Joseph Horsford Kemp, Registrar of the Supreme Court,

produces Original Jurisdictien file of Action 227/04.

Mr. Howell states he does not wish to put any

question to Mr. Kemp.

Mr. Howell further states:-

When the account was rendered on 22nd. July, 1896, I

had not recovered a cent of the original $1,500, Mr. Tatam løft

the Colony about the 6th. or 7th. January, 1897, and came back

in January,

1899. I drew two cheques of $500 and $300 dated the

27th. April, 1896, and 7th. August, 1896, respectively. I also

paid in as capital to the Butchery on the 17th. October, 1895,

$500. On the 1st. November, 1895, I paid in as capital to the

Butchery $1,000. On the 4th. December, 1895, I paid in as

capital $500. On the 22nd. January, 1896, I paid in as capital

$1,500. On 3rd. November, 1896, I paid as capital to the Butchery $500. The $500 and $300 which I drew out was against

general capital. These capital payments were made to the

general account and not to capital account. Mr. Tatam did not

put in any capital.

In reply to a question by Mr. Hewett

The business being at times (at all events) run at a

loss the capital paid in by me would be used to meet the current

expenses of the business.

Hr. Tatam lived with me and drew money which he

required from the funds of the Butchery. In 1895 and 1896 ay

salary was between $250 or $300. Part of the money I paid in

I borrowed from friends. I paid these friends interest. For the first two weeks Mr. Tatam signedall the cheques. On the 16th October, 1895, Mr. Tatam drew three cheques of $518.73, $445.90 and $39.80. At that time there was not sufficient in the Bank to

meet these accounts. One cheque was protested. When that cheque

was returned to Tatam he came and saw me about it. I told him
